“The Complexity of Subrogation: Condominium Projects, The Anti-Subrogation Rule, and Landlord/Tenant Issues”

In this presentation, various issues arising in condominium projects and landlord/tenant situations will be discussed. Participants will learn about the potential issues that arise in subrogation investigations and be able to identify the types of documentation that should be requested to assist in developing potential subrogation targets. We will discuss condominium projects and the unique ownership interests giving rise to a variety of methods of insuring condominium projects to be considered when evaluating subrogation, including “bare walls,” “single entity,” and “all inclusive” arrangements. Waivers of subrogation and common issues arising when condo associations and/or individuals waive subrogation rights must be considered, in additional to the potential bar posed by the Anti-Subrogation Rule and co-insureds, including implied co-insureds. Securing and understanding the relevant documents including contracts, leases, certificates of insurance and policies early, in addition to the general considerations underlying all subrogation analyses, will be key to establishing the likelihood of potential recovery in the residential condo and landlord/tenant scenarios.
About the Presenters
Samuel Pace, Jr. – Mr. Pace’s practice consists of major property subrogation matters, complex recovery litigation, litigation arising from catastrophic losses, injuries, and professional liability. He graduated from the University of Pennsylvania and Villanova University School of Law. He is a former Board Member of the National Association of Subrogation Professionals (NASP), and a member of Loss Executives Association (LEA) and FDCC (former vice chair of Property Section).
Amy Murry – focuses her practice in the field of insurance subrogation and general casualty defense through the United States. She represents property and casualty insurers in matters concerning complex commercial and residential property losses involving fires, water losses, negligent construction, and product defects.
